BILL NUMBER: S8609 SPONSOR: WALCZYK TITLE OF BILL: An act to amend the penal law, in relation to allowing certain firearm licensees to open carry PURPOSE OR GENERAL IDEA OF BILL: This bill would amend the penal law to allow New Yorkers to open carry firearms. SUMMARY OF PROVISIONS: Section 1: Amends chapter 371 of 2022 to include open carry as an option for individuals who are filling out a firearm permit, in addition to concealed carry. Section 2: Sets the effective date.

S T A T E O F N E W Y O R K ________________________________________________________________________ 8609 I N S E N A T E February 21, 2024 ___________ Introduced by Sen. WALCZYK -- read twice and ordered printed, and when printed to be committed to the Committee on Codes AN ACT to amend the penal law, in relation to allowing certain firearm licensees to open carry THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph (f) of subdivision 2 of section 400.00 of the penal law, as amended by chapter 371 of the laws of 2022, is amended to read as follows: (f) have and POSSESS, AND carry OPENLY OR concealed, without regard to employment or place of possession subject to the restrictions of state and federal law, by any person; and § 2. This act shall take effect on the first of November next succeed- ing the date on which it shall have become a law. Effective immediately, the addition, amendment and/or repeal of any rule or regulation neces- sary for the implementation of this act on its effective date are authorized to be made and completed on or before such effective date.
