BILL NUMBER: S8698 SPONSOR: CLEARE TITLE OF BILL: An act to amend the education law, in relation to requiring monthly inspections of all AED equipment PURPOSE OR GENERAL IDEA OF BILL: Requires monthly inspections of all AED equipment in all school build- ings. SUMMARY OF PROVISIONS: Section 1 amends Section 917 of the education law by adding a new subdi- vision 5 which states that all AED equipment shall be inspected and tested at intervals not exceeding one month by any staff who holds a valid certification of completion of a course in the study of the oper- ations of AEDs. Additionally, any AED device that does not meet such applicable standards shall be exchanged for a new AED device with the coordinating emergency health care provider pursuant to section 3000b of

CLEARE -- read twice and ordered printed, and when printed to be committed to the Committee on Education AN ACT to amend the education law, in relation to requiring monthly inspections of all AED equipment THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 917 of the education law is amended by adding a new subdivision 5 to read as follows: 5. ALL AED EQUIPMENT SHALL BE INSPECTED AND TESTED AT INTERVALS NOT EXCEEDING ONE MONTH BY ANY STAFF WHO HOLDS A VALID CERTIFICATION OF COMPLETION OF A COURSE IN THE STUDY OF THE OPERATION OF AEDS. INSPECTIONS AND TESTS SHALL BE PERFORMED IN ACCORDANCE WITH THE APPLICA- BLE STANDARDS OF THE MANUFACTURER AND ANY APPROPRIATE GOVERNMENT AGENCY. ANY AED DEVICE THAT DOES NOT MEET SUCH APPLICABLE STANDARDS SHALL BE EXCHANGED FOR A NEW AED DEVICE WITH THE COORDINATING EMERGENCY HEALTH CARE PROVIDER PURSUANT TO SECTION THREE THOUSAND-B OF THE PUBLIC HEALTH LAW. A WRITTEN RECORD OF ALL MAINTENANCE AND TESTING PERFORMED ON AEDS SHALL BE MAINTAINED AND SUBMITTED ANNUALLY TO THE COMMISSIONER OF HEALTH. § 2. This act shall take effect immediately.
