BILL NUMBER: S928 SPONSOR: PERSAUD TITLE OF BILL: An act to amend the administrative code of the city of New York, in relation to increasing fines for individuals who fail to comply with a stop work order PURPOSE OR GENERAL IDEA OF BILL: To ensure that proper penalties are issued for individuals that violate law. SUMMARY OF SPECIFIC PROVISIONS: Section 1 amends section 47 of part A of local law number 141 of the administrative code of the city of New York to add a civil penalty for any person who fails to comply with a stop work order in the amount of ten thousand dollars for the initial violation and then twenty thousand dollars for every subsequent violation, to be paid to the department.

PERSAUD -- read twice and ordered printed, and when printed to be committed to the Committee on Cities 1 AN ACT to amend the administrative code of the city of New York, in relation to increasing fines for individuals who fail to comply with a stop work order THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 28-207.2.6 of the administrative code of the city of New York, as amended by section 2 of part A of local law number 126 of the city of New York for the year 2021, is amended to read as follows: § 28-207.2.6 Penalties. In addition to the penalties provided for in this chapter, any person who fails to comply with a stop work order shall be liable for a civil penalty in the amount of [$6,000] $10,000 for the initial violation and [$12,000] $20,000 for every subsequent violation, to be paid to the department prior to the rescission of the stop work order; provided, however, this shall not apply to any work performed to remedy an unsafe or hazardous condition as authorized by order of the commissioner. § 2. This act shall take effect on the ninetieth day after it shall have become a law. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD01711-01-3
