BILL NUMBER: S6995 SPONSOR: WEBER TITLE OF BILL: An act to amend the executive law, in relation to authorizing a county, city, town or village to override a state disaster emergency in all or part of the territorial limits of such local government PURPOSE: Allows a county, city, town or village government to override a state disaster of emergency in all or part of that county, city, town or village's territorial limits. SUMMARY OF PROVISIONS: Section 1. Amends Section 28 of the Executive Law. Section 2. Amends Section 29-a of the Executive Law. Section 3. Sets the effective date.

WEBER, ROLISON -- read twice and ordered printed, and when printed to be committed to the Committee on Veterans, Home- land Security and Military Affairs AN ACT to amend the executive law, in relation to authorizing a county, city, town or village to override a state disaster emergency in all or part of the territorial limits of such local government THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 28 of the executive law is amended by adding a new subdivision 6 to read as follows: 6. A COUNTY, CITY, TOWN OR VILLAGE MAY, AT ANY TIME, LIMIT OR SUPER- SEDE A GOVERNOR'S DECLARATION OF A DISASTER EMERGENCY BY EXECUTIVE ORDER ISSUED UNDER THIS SECTION, BY ISSUING A LOCAL STATE OF EMERGENCY AND LOCAL EMERGENCY ORDERS UNDER SECTION TWENTY-FOUR OF THIS ARTICLE. THE LOCAL STATE OF EMERGENCY AND LOCAL EMERGENCY ORDERS SHALL ONLY EFFECT PART OR ALL OF THE TERRITORIAL LIMITS OF SUCH LOCAL GOVERNMENT. § 2. Section 29-a of the executive law is amended by adding a new subdivision 5 to read as follows: 5. This act shall take effect immediately and shall apply to any executive order issued by the governor on or after January 1, 2023.
