TITLE OF BILL:

An act to amend chapter 54 of the laws of  2024,  enacting  the  capital
projects budget, in relation to safety and security projects at small
businesses at risk of hate crimes

 
PURPOSE:

To increase funding for the Securing Communities Against Hate Crimes
Grant program to $100 million and expand the program's eligibility to
also include small businesses

 
SUMMARY OF PROVISIONS:

Section 1: Amends Chapter 54 of the Laws of 2024 to increase funding for
the Securing Communities Against Hate Crimes Grant program to increase
funding to $100 million, and to expand eligibility to the program to
small businesses. Further, provides that at least $50 million will be
made available for not-for-profits and small businesses at risk of anti-

semitic hate crimes or attacks.

Section 2: Provides the effective date.

 
JUSTIFICATION:

Alarmingly, more than 15% of all antisemitic incidents that took place
in the United States in 2022 occurred in New York State according to
statistics from the Anti-Defamation League. Perhaps even more concerning
is that after the llamas attack on Israel on October 7, 2023, some
across the world-including within the United States and New York State-
have expressed support for this horrific and tragic event. Now, more
than ever in recent history, it is important that New York State take
action to ensure our Jewish community have the resources they need to
feel and be safe. This legislation would increase the Securing Communi-
ties Against Hate Crimes Grant program to $100 million, expand eligibil-
ity to include small businesses, and provide that at least $50 million
from the program will be dedicated to not-for-profits and small busi-
nesses at risk of antisemitic hate crimes or attacks.

FISCAL IMPLICATIONS:

This legislation would invest an additional $65 million toward protect-
ing New Yorkers and those visiting the state.

 
EFFECTIVE DATE:
This act shall take effect immediately and shall be deemed to have been
in full force and effect on and after April 1, 2024.

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  Section 1 of chapter 54 of the laws of 2024, enacting the
 capital projects  budget, is amended by repealing the items  hereinbelow
 set  forth  in  brackets and by adding to  such  section the other items
 underscored in this section.

   limited to, at a facility, virtually or on
   the internet because  of  their  ideology,

   beliefs  or mission, PROVIDED THAT NO LESS
   THAN $50,000,000  BE  MADE  AVAILABLE  FOR
   NOT-FOR-PROFITS  AND  SMALL  BUSINESSES AT
   RISK   OF   ANTISEMITIC   HATE  CRIMES  OR
   ATTACKS. Provided that  an  assessment  of
   facilities at risk may include, but not be
   limited  to, considerations of the vulner-
   abilities of the organization based on its
   location and membership, and the potential
   consequences of a hate crime or attack  at
   the  facility.  Recipients  of such grants
   shall be entitled to  use  such  funds  to
   purchase  commodities, services, and tech-
   nology   through   centralized   contracts
   established   by  the  office  of  general
   services under section 163  of  the  state
   finance  law, and such recipients shall be
   deemed for such purpose to  be  authorized
   users within the meaning of paragraph k of
   subdivision  1 of section 163 of the state
   finance law. All or a portion of the funds
   appropriated herein may be suballocated to
