BILL NUMBER: S5338 SPONSOR: FAHY TITLE OF BILL: An act to amend the criminal procedure law, in relation to transferring control of a defendant's connected devices in a family offense proceed- ing PURPOSE OR GENERAL IDEA OF BILL: To permit courts to transfer the control of an electronic device to prevent electronic stalking by a family or household member. SUMMARY OF PROVISIONS: Section 1 amends Criminal Procedure Law § 530.12(8) by adding a new paragraph (C) to permit the court to order a defendant in a family court proceeding to turn control of an electronic device over to another person or to have the device disabled by the manufacturer. Section 2 provides an effective date.

FAHY -- read twice and ordered printed, and when printed to be committed to the Committee on Children and Families AN ACT to amend the criminal procedure law, in relation to transferring control of a defendant's connected devices in a family offense proceeding THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subparagraph 8 of paragraph (a) of subdivision 1 of section 530.12 of the criminal procedure law is amended by adding a new clause (C) to read as follows: (C) UPON MOTION AND AFTER AN OPPORTUNITY TO BE HEARD, THE COURT MAY ORDER THE DEFENDANT TO TURN CONTROL OF A CONNECTED DEVICE OVER TO A FAMILY OR HOUSEHOLD MEMBER OR, IF THAT IS NOT POSSIBLE, TO HAVE SUCH CONNECTED DEVICE DISABLED BY THE MANUFACTURER. § 2.
