§ 41. Violation of chapter a misdemeanor. Except as otherwise
provided by the penal law, a person who by himself or another violates
any of the provisions of this chapter or of any other law the
enforcement of which is within the jurisdiction of the department, is
guilty of a misdemeanor, and upon conviction shall, except as otherwise
provided in this chapter, be punished by a fine of not less than
twenty-five dollars, nor more than two hundred dollars, or by
imprisonment for not less than one month, nor more than six months, or
by both such fine and imprisonment, for the first offense; and by not
more than one year's imprisonment for the second offense.
