Selling prices and container deposits
General Business (GBS) CHAPTER 20, ARTICLE 26
§ 399-o. Selling prices and container deposits. Every person, firm,
partnership, corporation or association which sells, offers for sale, or
exposes for sale at retail an item for which the seller is required by
state or local law, ordinance or rule, to collect from the purchaser a
refundable deposit on beverage containers, shall not include the cost of
the mandated deposit when displaying the selling price of the item
through item pricing tags, point-of-sale signs, advertisements, or any
other means by which consumers might be informed of the cost of the
item. Nothing in this section shall prevent the seller from separately
indicating the amount of the deposit provided, however, that the deposit
is excluded from the indicated total cost and it is appropriately
identified as a deposit.
