Limitation on power of the authority
Public Authorities (PBA) CHAPTER 43-A, ARTICLE 8, TITLE 13
* § 2037. Limitation on power of the authority. Notwithstanding any
other provision of this title, the authority, on and after the effective
date of this section, shall not exercise any of the powers granted
pursuant to subdivisions three, four, six, seven, eight, nine, ten,
thirteen, fourteen and fifteen of section two thousand eighteen, or
section two thousand twenty or two thousand twenty-one of this title,
without approval by resolution of the county legislature; provided,
however, that the authority may continue to exercise such powers granted
pursuant to subdivisions three, four, six, seven, eight, nine, ten,
thirteen, fourteen and fifteen of section two thousand eighteen of this
title as may be necessary for the routine operation and ordinary
maintenance of the properties of the authority unless the county
legislature otherwise acts to the contrary within forty-five days of the
submission to the county legislature of a request by the authority for
approval to exercise any such powers.
