January 14, 2014
The New York State Commercial Goods Industry Fair Play Act, co-sponsored by Senator Dilan, was signed into law by Governor Cuomo. The legislation resolves the misclassification of commercial truck drivers, who are often listed a an "independent contractors" even though they are employed by a single commercial goods transportation company.
Unlike their truly independent counterparts, these misclassified workers are subject to company controls and are financially dependent on the company. Often they are deprived of proper social security benefits, healthcare, workers' compensation, unemployment benefits, minimum wage protections, the right to organize, and the right to a safe and healthful workplace.
