Senator Fuschillo Hails Senate Passage Of Measure To Increase Penalty For Repeat Dwai Offenders

State Senator Charles J. Fuschillo hailed Senate passage of legislation that would increase the penalty for drivers convicted of their fourth Driving While Ability Impaired (DWAI) conviction. The measure creates a new felony offense for those with three prior DWAI convictions who are again caught driving while under the influence of alcohol or drugs.

Senator Fuschillo (Merrick), a sponsor of the legislation, said, "We simply cannot allow drunk and drugged driving to continue in New York State, the consequences are too dire. Serial drunk drivers in particular are responsible for the majority of alcohol-related fatalities. This ‘zero tolerance’ legislation is a positive step towards saving lives on our roadways."

Under the legislation (S.43), after three prior DWAI convictions, a person convicted of yet another DWAI within a 10 year period would be charged with a Class E felony, punishable by up to four years in prison and a fine of up to $5,000.
