Senator Fuschillo's Legislation To Strengthen State's "do Not Call" Registry Law Approved By Senate

State Senator Charles J. Fuschillo, Jr. announced that the State Senate this week approved legislation that he sponsored to bring New York State’s "Do Not Call" law into compliance with the National "Do Not Call" law, to better protect New York consumers from unsolicited telemarketing calls. Under the legislation, telemarketers and businesses would have to update their New York State "Do Not Call" list every 31 days rather than every 90 days under current law.

Senator Fuschillo (R-Merrick) said, "This legislation would protect more New Yorkers from unwanted telemarketing calls, bring consistency and uniformity to the state law and clear up any confusion that businesses may have had in complying with both the national and state law."

In October 2000, New York State enacted a "Do-Not-Call" law sponsored by Senator Fuschillo, which was maintained by the Consumer Protection Board. The law required telemarketers and businesses to update their New York State "Do-No-Call" lists every 90 days.
In 2003, the federal government created a National "Do-Not-Call" Registry, and New York State played an important role in the implementation of the program.

Like the New York program, the national program also required telemarketers and businesses to update their list every 90 days. That delay between updates, however, was found to detract from the mission of preventing unwelcome telemarketing calls. Consequently, in 2004, the federal "Do-Not- Call" law was strengthened by requiring telemarketers and businesses to update "Do Not Call" lists every 31 days.

The state legislation that Senator Fuschillo is sponsoring (S. 3543) will update the New York State’s law to comply with the federal law.
