Senator Golden Announces Legislation to Protect Rental Car Rights for Auto Insurers

Brooklyn – State Senator Martin J. Golden (R, C, I, Brooklyn) is pleased to announce the passage of Senate Bill 4651. There have been instances of insurers steering their customers with rental vehicle reimbursement coverage to use one particular rental vehicle company. This bill will help not only the consumer but rental car companies as well.
Senator Golden stated “As a member of the Insurance Committee within the State Senate many cases like this have come across my desk and, as your representative, I will continue to work to protect the rights of consumers so that we have a safe place to live, work and raise our families.”
The three main sections in this bill that would bring about equality in the process are:
· prohibit insurers providing rental vehicle reimbursement coverage from requiring an insured to utilize a particular rental vehicle company, rental vehicle company location or a particular concern;
· require insurers to disclose to the insured that the insured has the right to utilize any particular rental vehicle company, rental vehicle company location or a particular concern; and
· require insurers writing automobile insurance that includes rental vehicle reimbursement coverage to inform the consumer of his or her rights granted under this section in a separate written document
“It is appropriate that the legislature passed a bill I sponsored in order to benefit business and protect the consumers. Those distressed after suffering a car accident do not need to be misinformed, over charged or taken advantage of in their possibly fragile state.” he concluded.
