Albany, NY – The New York State Senate has passed Senator Tom Croci’s (R-C-I, Sayville) bill to include the murder of a member of the military or reserves to the first degree murder statute.
The legislation (S4520B) seeks to amend the state penal law to add the killing of a member of the military or the reserves, who at the time of the murder was engaged in the course of performing their duties, to the first degree murder statute. The first degree murder statute already includes the killings of police officers, peace officers, firefighters, emergency medical personnel, state correctional officers, witnesses to a crime, and judges.
This is a new bill and would be effective immediately if passed by the Assembly and signed by the Governor.
