Senate Passes Legislation to Better Protect Victims of Domestic Violence and Other Crimes

Measure Would Notify Victims When Their Protection Order Request Has Been Served

The New York State Senate today passed legislation that bolsters protections for domestic violence and other crime victims by enhancing the state’s automated victim notification system. The bill (S4060), sponsored by Senator Andrew Lanza (R-C-I, Staten Island), immediately informs individuals who sought an order of protection when that order is issued, providing vital information to victims when they are in greatest danger.

Senator Lanza, Chairman of the Senate’s Codes Committee said, “One of the most dangerous times for a victim is when an order of protection is served, and timely notice to the victim is essential so that they can plan for their safety. I’m proud to have authored this legislation which extends New York’s automated victim notification system to include protective orders, making both victims and criminal justice agencies better equipped during this vulnerable time.”

Thousands of victims are killed or re-victimized each year immediately after an order of protection is served on their abuser. This bill would provide security and emotional peace of mind by allowing victims to be notified in real time when their protection order request has been served. 

Notification of protective orders can be by mail, telephone, E-mail, or other means of electronic communication. Furthermore, by passing this legislation New York would be eligible for federal grants that help states expand their victim notification systems.  

The bill will be sent to the Assembly.
