Hoylman Bill Clears Both Houses, Banning Use of Gay and Trans Panic

ALBANY, NY – Senator Brad Hoylman (D/WF-Manhattan), the only openly-LGBTQ member of the State Senate, released the following statement in response to the passage of his legislation (S6573/A8375) to limit the use of extreme emotional disturbance as an affirmative defense, commonly known as the “Gay Panic” or “Trans Panic” defense, through both houses of the legislature. The legislation now heads to Governor Cuomo’s desk, where it is expected to be signed into law.

Senator Brad Hoylman said: “For decades, LGBTQ New Yorkers fought for basic recognition that they mattered under New York law. This session, we’ve made it clear that they do. We banned the barbaric practice of conversion therapy and with GENDA now the law of the land, the full force of law stands behind transgender and gender-non-conforming New Yorkers.

In banning the gay and trans panic defense, New York is sending a message to prosecutors, to defense attorneys, juries and judges that a victim’s LGBTQ identity can’t be weaponized. On the 50th anniversary of Stonewall, it’s long past time we do so. I’m proud to be a member of a legislature that fights to make New York a more inclusive, equitable place and thank Assemblymember O’Donnell for his support on this critical issue.”
