Hoylman To BOE: Claw Back Contract From Brooklyn Ballot Bunglers

NEW YORK -- This week Phoenix Graphics, Inc. sent out around 100,000 absentee ballots to the incorrect recipients. Senator Brad Hoylman (D,WF-Manhattan) issued the following statement urging the New York City Board of Elections to invoke a clawback clause in its contract with Phoenix Graphics, due to the vendor’s unsatisfactory performance of services. This could return the $4.6 million from their no-bid contract to BOE coffers.
Senator Hoylman said: “I read through Phoenix Graphics’ contract with the Board of Elections. It allows for a clawback for breach of contract. If this wasn’t a breach of contract, I don’t know what is. Their egregious error plays directly into the hands of Donald Trump in his effort to undermine faith in our elections, and threatens to disenfranchise older and immunocompromised New Yorkers for whom absentee ballots are the safest way to vote. Phoenix Graphics doesn’t deserve a penny in taxpayer dollars. After the election is over, we should take back that $4.6 million and use it to pay for efforts to protect voters in the 2021 election.”
