Senate Deputy Leader Gianaris To Introduce Resolution Terminating Any Extension Of NYC Curfew
June 6, 2020
NEW YORK – Senate Deputy Leader Michael Gianaris, the highest ranking Senator from New York City, announced he intends to introduce a resolution to terminate any Emergency Executive Order issued by Mayor Bill deBlasio continuing a curfew beyond its current expiration on June 8th. New York City is currently under a city-wide curfew from 8pm-5am, pursuant to the Mayor’s Emergency Executive Order number 118. The curfew has seen many documented cases of arbitrary assaults and arrests of peaceful protestors, members of the media, legal observers, and other essential workers.
“Enforcement of this ill-advised curfew has allowed the police to target peaceful New Yorkers whose rights they should be defending, not suppressing,” said Senate Deputy Leader Michael Gianaris. “If the Mayor insists on continuing down this dark path, then the legislature must use our powers to stop it.”
New York State Executive Law Section 24(8) specifically grants the legislature authority to terminate such orders by Concurrent Resolution. The legislature will be in session this coming week. Such resolutions do not require approval of the Governor.
