June 4, 2024
ALBANY, NY – In the last week of the 2024 legislative session, the New York State Senate passed S.9518, sponsored by Senator Kristen Gonzalez (SD59-D/WFP). The Assembly same-as (A….) is sponsored by Assembly Member Michaelle Solages (AM22-D). The bill intends to prohibit the judicial system from denying class action classification for reasons solely based on the involvement of government entities.
Senator Kristen Gonzalez said, “We’re taking a crucial step towards equitable justice by championing a bill that ensures fairness in our courts. By passing this bill, we reaffirm the principles of equality and accountability, and uphold that every individual, regardless of circumstance, deserves their day in court.”
This legislation seeks to prevent a court from denying or withholding class certification solely because a lawsuit involves governmental operations and allow all New Yorkers the opportunity to seek justice while streamlining the litigation process in the courts.
S.9518 removes arbitrary barriers to class action classification and signifies a commitment to transparency, fairness, and the preservation of rights within our legal system.
