                                 BILL NUMBER:  S1464

 TITLE OF BILL :  An act to amend the education law, in relation to
the fund for innovation grants

 PURPOSE :

This Legislation establishes Fund for Innovation grants not to exceed
$30 million a year. This program will commence in the 2013-2014 school
year.

 SUMMARY OF PROVISIONS :

Adds subdivision 17 to Section 3641 of the Education Law to establish
Fund for Innovation grants. These grants would begin in the 2015-16
school year and are to be used to create public/private partnerships
to develop and implement technology-based learning strategies. These
grants will total $30 million per year. $15 million of these funds are
provided to the Big 5 City School Districts via a formula based upon
student enrollment levels. The remaining $15 million is provided to
school districts outside of the Big 5. These funds will be allocated
pursuant to a competitive grant program operated by the Commissioner
of Education. The Commissioner will allocate these funds based upon
the technology needs of the school district and the ability of the
district to increase student academic performance.

 JUSTIFICATION :

Technology can play a key component in increasing academic performance
of students who are failing to meet the State learning standards.  The
interactivity provided by technology-based learning strategies can be
a key component in serving high needs pupils and those in danger of
lagging in academic performance. In addition, many private firms have
developed many of these technology-based learning instruments.
However, New York State does not have a program which connects the
needs of at-risk public school students with the learning technology
programs which have been developed.

The Fund for Innovation provides grants for programs which develop and
implement public/private partnerships that establishes innovative
technology based learning strategies for high-needs students and those
children in danger of failing to meet the learning standards.  In
filling this need, the Fund for Innovation will offer a benefit to
needy school districts which lack sufficient technology access, while
providing at-risk students with additional education opportunities to
meet the learning standards.

 FISCAL IMPLICATIONS :

This bill establishes a $30 million school year program. In the
2015-16 State Fiscal Year approximately half of the grant total is
expected to be allocated to school districts.

 EFFECTIVE DATE :
This act shall take effect immediately.

 AN  ACT  to  amend  the education law, in relation to the fund for inno-
   vation grants
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section  1.  Section  3641 of the education law is amended by adding a
 new subdivision 17 to read as follows:
   17. FUNDS FOR INNOVATION GRANTS.  A.  IN  ADDITION  TO  APPORTIONMENTS
 OTHERWISE  PROVIDED PURSUANT TO THIS ARTICLE, FOR AID PAYABLE IN THE TWO
 THOUSAND SEVENTEEN--TWO THOUSAND EIGHTEEN SCHOOL  YEAR  AND  THEREAFTER,
 THIRTY  MILLION  DOLLARS  SHALL  BE  AVAILABLE AND ALLOCATED PURSUANT TO
 PARAGRAPHS B AND C OF THIS SUBDIVISION AND SHALL BE PAID FOR PROGRAMS TO
 CREATE PUBLIC/PRIVATE PARTNERSHIPS TO DEVELOP AND IMPLEMENT  INNOVATIVE,
 TECHNOLOGY-BASED  LEARNING  STRATEGIES  TO  SERVE  HIGH-NEED  PUPILS AND
 PUPILS WHO ARE AT RISK OF NOT MEETING THE NEW YORK STATE LEARNING STAND-
 ARDS PURSUANT TO REGULATIONS OF THE  COMMISSIONER,  INCLUDING,  BUT  NOT
 LIMITED  TO,  THE  CREATION  OF  ONE-TO-ONE  LAPTOP  PILOT PROGRAMS, THE
 PURCHASE OF CONTENT-BASED SOFTWARE  AND/OR  SUPPORT  OF  PROGRAMS  WHICH
 PROVIDE  NEW  YORK STATE LEARNING STANDARDS-ALIGNED EDUCATIONAL CONTENT,
 CLASS LESSONS AND RELATED PROFESSIONAL DEVELOPMENT.
   B. ANY SCHOOL DISTRICT LOCATED IN A CITY WITH  AT  LEAST  ONE  HUNDRED
 TWENTY-FIVE THOUSAND INHABITANTS, SHALL BE ELIGIBLE FOR A GRANT PURSUANT
 TO THIS SECTION FOR THE PURPOSES CONTAINED IN PARAGRAPH A OF THIS SUBDI-
 VISION.  ANY  SCHOOL DISTRICT LOCATED WITHIN A CITY WITH A POPULATION OF
 ONE MILLION OR MORE INHABITANTS SHALL BE ELIGIBLE FOR AN AMOUNT OF UP TO
 FORTY PERCENT OF THE TOTAL AMOUNT ALLOCATED PURSUANT TO THIS  PARAGRAPH.
 ANY  CITY SCHOOL DISTRICT OF A CITY HAVING A POPULATION OF LESS THAN ONE
 MILLION BUT IN EXCESS OF ONE HUNDRED TWENTY-FIVE  THOUSAND  INHABITANTS,
 SHALL  BE  ELIGIBLE  FOR  AN AMOUNT EQUAL TO THE PRODUCT, ROUNDED TO THE
 NEAREST DOLLAR, OF (I) SIXTY  PERCENT  OF  THE  TOTAL  AMOUNT  ALLOCATED

 PURSUANT TO THIS PARAGRAPH, AND (II) THE QUOTIENT OF THE DISTRICT'S BASE
 YEAR  ENROLLMENT ON FILE WITH THE COMMISSIONER AS OF THE DATE UPON WHICH
 AN ELECTRONIC DATA FILE WAS CREATED FOR THE PURPOSES OF COMPLIANCE  WITH
 PARAGRAPH  B  OF SUBDIVISION TWENTY-ONE OF SECTION THREE HUNDRED FIVE OF
 THIS CHAPTER ON NOVEMBER FIFTEENTH OF THE BASE YEAR, DIVIDED BY THE  SUM
 OF  SUCH BASE YEAR ENROLLMENTS FOR ALL SUCH CITY SCHOOL DISTRICTS.  SUCH
 GRANTS SHALL NOT EXCEED FIFTEEN MILLION DOLLARS AND SHALL BE AWARDED  BY
 THE  COMMISSIONER  PURSUANT  TO A COMPETITIVE GRANT PROCESS. THE COMMIS-
 SIONER SHALL EVALUATE EACH GRANT APPLICATION ON THE  BASIS  OF  CRITERIA
 INCLUDING  BUT  NOT  LIMITED  TO:  THE  TECHNOLOGY  NEEDS  OF THE SCHOOL
 DISTRICT, AND THE ABILITY OF THE SCHOOL  DISTRICT  TO  IMPROVE  ACADEMIC
 PERFORMANCE BY THE USE OF THESE TECHNOLOGIES.
   C.  ANY  SCHOOL  DISTRICT  LOCATED OUTSIDE OF A CITY WITH AT LEAST ONE
 HUNDRED TWENTY-FIVE THOUSAND INHABITANTS, SHALL BE ELIGIBLE FOR A  GRANT
 PURSUANT  TO  THIS  SECTION FOR THE PURPOSES CONTAINED IN PARAGRAPH A OF
 THIS SUBDIVISION. SUCH GRANTS SHALL NOT EXCEED FIFTEEN  MILLION  DOLLARS
 AND SHALL BE AWARDED BY THE COMMISSIONER PURSUANT TO A COMPETITIVE GRANT
 PROCESS.  THE  COMMISSIONER SHALL EVALUATE EACH GRANT APPLICATION ON THE
 BASIS OF CRITERIA INCLUDING BUT NOT LIMITED TO, THE TECHNOLOGY NEEDS  OF
 THE  SCHOOL  DISTRICT, AND THE ABILITY OF THE SCHOOL DISTRICT TO IMPROVE
 ACADEMIC PERFORMANCE BY THE USE OF THESE TECHNOLOGIES.
   § 2. This act shall take effect immediately.
