BILL NUMBER: S3066 SPONSOR: LANZA TITLE OF BILL: An act authorizing the study of fees and charges assessed to residents of assisted living facilities PURPOSE: The purpose of this bill is to authorize a study that will review the rate of the fees and charges being assessed to residents of assisted living facilities. SUMMARY OF SPECIFIC PROVISIONS: This bill would direct the Department of Health and the Office of the Aging to study the fees and charges being assessed to residents of assisted living facilities. This study would be delivered on or before April 1, 2019.

S T A T E O F N E W Y O R K ________________________________________________________________________ 3066 2019-2020 Regular Sessions I N S E N A T E February 1, 2019 ___________ Introduced by Sen. LANZA -- read twice and ordered printed, and when printed to be committed to the Committee on Aging AN ACT authorizing the study of fees and charges assessed to residents of assisted living facilities THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The department of health in conjunction with the office for the aging is authorized and directed to study the fees and charges being assessed to residents of assisted living facilities. Specifically, such study shall review the rate of increase of the fees and charges being assessed to residents of assisted living facilities. § 2. On or before April 1, 2021, the commissioner of the department of health and the director of the office for the aging shall deliver a copy of the findings of the study conducted pursuant to section one of this act and any legislative recommendations they deem to be necessary to the governor, the temporary president of the senate, and the speaker of the assembly. § 3. The commissioner of the department of health and the director of the office for the aging may request, and are authorized to receive, any information from any state agencies or assisted living facilities that is relevant and material to the completion of this study and report. Such information received by the department of health and the office for the aging shall be subject to the same requirements for confidentiality and limitations on use, if any, as are applicable to each such state agency's use of such information. § 4. This act shall take effect immediately and shall be deemed repealed thirty days after the delivery of the report to the governor and the legislature as provided for in section two of this act; provided that the department of health or the office for the aging shall notify the legislative bill drafting commission upon the occurrence of the delivery of the report provided for in section two of this act in order EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
