 Introduced  by  Sen.  BIAGGI -- read twice and ordered printed, and when
   printed to be committed to the Committee on Health
 
 AN ACT to amend the public health law, in relation to requiring a certi-
   fied dietitian on-site during hours of operation  at  a  comprehensive
   care center for eating disorders

   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Paragraphs (c) and (d) of subdivision 1 of  section  2799-g
 of  the  public health law, paragraph (c) as added by chapter 114 of the
 laws of 2004 and paragraph (d) as amended by section 12  of  part  A  of
 chapter 109 of the laws of 2010, are amended to read as follows:
   (c)  The  applicant is able to conduct activities for community educa-
 tion, prevention, information/referral and research; [and]
   (d) The applicant meets such additional criteria as are established by
 the commissioner; AND
   (E) THE APPLICANT HAS A CERTIFIED  DIETITIAN  AS  DEFINED  IN  SECTION
 EIGHT  THOUSAND  ONE OF THE EDUCATION LAW ON-SITE DURING HOURS OF OPERA-
 TION.
   § 2. This act shall take effect immediately.
