 AN ACT to amend the executive law, in relation to requiring the division
   of human rights to develop an anti-bias and inclusion training program
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1. The executive law is amended by adding a new section 296-e
 to read as follows:
   § 296-E. ANTI-BIAS AND INCLUSION TRAINING PROGRAM.   1.  THE  DIVISION
 SHALL  DEVELOP  A  TRAINING  PROGRAM  FOR ALL EMPLOYEES OF THE OFFICE OF
 PARKS, RECREATION AND HISTORIC PRESERVATION, THE OLYMPIC REGIONAL DEVEL-
 OPMENT AUTHORITY, AND THE DEPARTMENT OF ENVIRONMENTAL  CONSERVATION  AND
 ALL  PRIVATE  CONTRACTORS  WORKING  FOR  THE  STATE AT SUCH AGENCIES WHO
 PERFORM PUBLIC-FACING FUNCTIONS. FOR PURPOSES OF THIS SECTION  THE  TERM
 "PUBLIC-FACING  FUNCTION"  SHALL  MEAN JOB FUNCTIONS THAT REQUIRE INTER-
 ACTION AND COMMUNICATION WITH THE PUBLIC.
   2. ALL EMPLOYEES AND PRIVATE CONTRACTORS DESCRIBED IN SUBDIVISION  ONE
 OF THIS SECTION SHALL COMPLETE SUCH TRAINING PROGRAM BIANNUALLY.
   3.  SUCH  ANTI-BIAS  AND INCLUSION TRAINING PROGRAM SHALL INCLUDE, BUT
 SHALL NOT BE LIMITED TO: (A) GENERAL  DISCUSSIONS  ABOUT  DIVERSITY  AND
 BIAS,  INCLUDING  UNCONSCIOUS BIAS; (B) TOOLS TO CREATE AN INCLUSIVE AND
 RESPECTFUL WORK ENVIRONMENT; (C) EXAMINATION OF EMPLOYEE'S OWN  PERSONAL
 BIASES;  AND (D) IDENTIFICATION OF WAYS TO RESPOND TO DISCRIMINATION AND
 BIAS.
   4. THE COMMISSIONER MAY PROMULGATE RULES AND REGULATIONS AS HE OR  SHE
 DEEMS  NECESSARY FOR THE PURPOSES OF CARRYING OUT THE PROVISIONS OF THIS
 SECTION.
   § 2. This act shall take effect immediately.

TITLE OF BILL:

An act to amend the public authorities law, in relation to requiring the
Olympic regional development authority, in consultation with the depart-
ment of environmental conservation and division of human rights to
develop an anti-bias and inclusion training program

 
PURPOSE:

To reduce bias incidents of bias in the Adirondack Park region in the
recreation and tourism sectors by providing regular anti-bias and inclu-
sion training.

 
SUMMARY OF PROVISIONS:

Section 1 amends the public authorities law to require the Olympic
Regional Development Authority to provide anti-bias training for its own
employees, as well as public-facing employees of the Department of Envi-

ronmental Conservation and private contractors within the boundaries of
the Adirondack Park. The division of Human Rights shall promulgate regu-
lations for the execution of this law.

Section 2 sets an effective date.

 
EXISTING LAW:

None

 
JUSTIFICATION:

In New York State and across the country, there have been a number of
incidents where people of visible minorities have been subjected to
mistreatment, harassment and even arrest as they go about their business
in restaurants, parks, or places of entertainment.

The tourism industry in particular is driven by attracting people from
other locations and cultures, but this sort of mistreatment not only
ruins the experiences of the people involved, but it also discourages
others from visiting.

Having a properly trained and culturally sensitive workforce in the
tourism industry is a necessary condition for economic development in
New York State.

 AN ACT to amend the public authorities law, in relation to requiring the
   Olympic  regional  development  authority,  in  consultation  with the
   department of environmental conservation and division of human  rights

   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1.   Subdivisions 15 and 16 of  section  2611  of  the  public
 authorities  law,  subdivision  15  as amended by section 3 of part C of
 chapter 60 of the laws of 2012 and subdivision 16 as  added  by  chapter
 404  of  the laws of 1981 and as renumbered by chapter 38 of the laws of
 1987, are amended and a new subdivision 17 is added to read as follows:
   15. To procure insurance against any loss or liability  in  connection
 with the use, management, maintenance and operation of the participating
 olympic facilities and/or Belleayre Mountain ski center, in such amounts
 and from such insurers, subject to public bidding as it deems desirable;
 [and]
   16.  To  do all things necessary, convenient or desirable to carry out
 its purposes and for the exercise of the powers granted in  this  title;
 AND
   17.  TO  DEVELOP, IN CONSULTATION WITH THE DEPARTMENT OF ENVIRONMENTAL
 CONSERVATION AND THE DIVISION OF HUMAN RIGHTS, AN ANTI-BIAS  AND  INCLU-
 SION TRAINING PROGRAM FOR ALL EMPLOYEES OF THE OLYMPIC REGIONAL DEVELOP-
 MENT  AUTHORITY,  THE  DEPARTMENT OF ENVIRONMENTAL CONSERVATION, AND ALL
 PRIVATE CONTRACTORS WORKING FOR THE STATE AT SUCH AGENCIES,  WORKING  IN
 TOURIST ACCOMMODATIONS OR TOURIST ATTRACTIONS IN ADIRONDACK PARK.

   (A)  FOR  PURPOSES  OF THIS SUBDIVISION THE FOLLOWING TERMS SHALL HAVE
 THE FOLLOWING MEANINGS ASCRIBED TO THEM:
   (I)  THE  TERM "ADIRONDACK PARK" SHALL MEAN LAND LYING WITHIN THE AREA
 DESCRIBED IN SUBDIVISION ONE OF SECTION 9-0101 OF ENVIRONMENTAL  CONSER-
 VATION LAW INCLUDING ANY FUTURE AMENDMENTS THERETO.
   (II)  THE  TERM  "TOURIST  ACCOMMODATION" SHALL MEAN ANY HOTEL, MOTEL,
 RESORT, TOURIST CABIN, STATE-OWNED CAMPGROUND OR  CAMPSITE,  OR  SIMILAR
 FACILITY DESIGNED TO HOUSE THE GENERAL PUBLIC.
   (III)  THE  TERM  "TOURIST  ATTRACTION" SHALL MEAN (I) ANY MAN-MADE OR
 NATURAL PLACE OF INTEREST OPEN TO THE GENERAL PUBLIC  FOR  WHICH  ADMIT-
 TANCE FEE IS USUALLY CHARGED, INCLUDING BUT NOT LIMITED TO ANIMAL FARMS,
 AMUSEMENT  PARKS, REPLICAS OF REAL OR FICTIONAL PLACES, THINGS OR PEOPLE
 AND NATURAL GEOLOGICAL FORMATIONS; AND (II) ANY NATURAL  ATTRACTION  FOR
 WHICH  NO  ADMITTANCE  FEE IS CHARGED, INCLUDING BUT NOT LIMITED TO, THE
 FOREST PRESERVE LANDS.
   (B) ALL EMPLOYEES AND PRIVATE CONTRACTORS DESCRIBED IN  THIS  SUBDIVI-
 SION  SHALL  COMPLETE  A MINIMUM OF THIRTY MINUTES OF SUCH ANTI-BIAS AND
 INCLUSION TRAINING PROGRAM ANNUALLY.
   (C) SUCH ANTI-BIAS AND INCLUSION TRAINING PROGRAM SHALL  INCLUDE,  BUT
 SHALL  NOT  BE  LIMITED  TO: (I) GENERAL DISCUSSIONS ABOUT DIVERSITY AND
 BIAS, INCLUDING UNCONSCIOUS BIAS; (II) TOOLS TO CREATE AN INCLUSIVE  AND
 RESPECTFUL   WORK  ENVIRONMENT;  (III)  EXAMINATION  OF  EMPLOYEE'S  OWN
 PERSONAL BIASES; AND (IV) IDENTIFICATION OF WAYS TO RESPOND TO DISCRIMI-
 NATION AND BIAS.
   (D) THE DIVISION OF HUMAN RIGHTS MAY PROMULGATE RULES AND  REGULATIONS
 AS  NECESSARY  FOR  THE  PURPOSES OF CARRYING OUT THE PROVISIONS OF THIS
 SUBDIVISION.
   § 2. This act shall take effect on the sixtieth  day  after  it  shall
 have become a law.
