Griffo: No tax on overtime and tips
March 17, 2025
Following the passage of Senate and Assembly’s One-House Budget Resolutions that did not provide significant relief for struggling New Yorkers, state Sen. Joseph Griffo, R-C-Rome, is calling for the elimination of state income taxes on overtime pay and cash tips to be included in this year’s Enacted Budget.
Sen. Griffo is also supporting legislation that would ensure New Yorkers can keep more of their hard-earned income in their own pockets. This includes:
- S.3914: Eliminating state income taxes on overtime pay; and
- S.587: Eliminating state income taxes on cash tips that are considered wages or compensation.
“So many New Yorkers are struggling financially because the state has become more and more unaffordable under the leadership of the legislative majorities and governor,” Sen. Griffo said. “We must do everything we can to provide important relief. This includes this legislation that would eliminate the state income taxes on overtime pay and cash tips. I remain committed to improving affordability and building a more prosperous New York.”
The One-House Budget Resolutions passed last week by the Senate and Assembly majorities is the start of the budget negotiating process and a direct reflection of where would like to take the state.
“While there were aspects of this proposal that I do agree with, I could not support the Senate's Resolution because it increases spending to unsustainable levels (a staggering $17 billion increase over the current budget), will further burden New Yorkers and their families and will not make the state more affordable,” Sen. Griffo said. “This proposal raises taxes, does not effectively address serious public safety concerns, lacks parity between all regions of the state, will implement additional onerous mandates and unaffordable and unrealistic energy regulations that will potentially eliminate the use of natural gas to heat homes and businesses and will result in increased energy bills. It also contains policy items, which I have always said should be discussed openly and transparently outside of the budget. As the budget process now moves forward, I will continue to push for a fiscally responsible budget and for policies and reforms that will make our state safer, stronger and more affordable.”
